The terms that govern your use of CognitivessAI's website, API, CLI and related services.

These Terms of Service ("Terms") govern your access to and use of the website (cognitivess.com), the API platform (api.cognitivess.com), the cognitivess command-line tool, and any related services (collectively, "the Service") operated by CognitivessAI ("we", "us", "our").
By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement, that you have the legal capacity to enter into these Terms, and that you have not been previously suspended or removed from the Service.
Some features require an account. When you create one, you agree to provide accurate and complete information and to keep it up to date. You are responsible for safeguarding your API keys and account credentials and for all activity carried out under your account. If you become aware of any unauthorised access, contact us immediately.
You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
The Service provides access to AI models, including Cognitivess-1. AI-generated outputs may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and verifying any output before relying on it, and for how you use it. We do not guarantee the accuracy, reliability, or fitness for a particular purpose of any AI output.
We do not use your inputs or outputs to train any AI model. See our Privacy Policy for details on how your data is handled.
We offer free and paid plans, and a pay-as-you-go credit system. The following payment terms apply:
We retain all rights, title, and interest in the Service, including the software, models, trademarks, branding, and content we publish, except as expressly stated in these Terms.
You retain ownership of the content (prompts, inputs, and outputs) you create through the Service. To the extent we process your content to provide the Service to you, you grant us a limited, non-exclusive licence to do so solely as necessary to operate the Service for you.
We respect copyright and other intellectual property laws. If you believe that content available through the Service infringes your rights, you may submit a notice-and-takedown request to [email protected] including: your contact details, identification of the protected work, identification of the allegedly infringing material, and a good-faith statement that the use is unauthorised. We will review valid requests and remove or disable access to the material where appropriate. We may terminate the accounts of repeat infringers.
The Service may integrate with or rely on third-party providers (for example, model inference providers, Stripe for payments, and infrastructure hosting). We are not responsible for the practices or availability of these third-party services, which are subject to their own terms and policies. Your use of any third-party service is solely at your own risk.
You may stop using the Service at any time. You can close your account by contacting us or through your dashboard.
We may suspend or restrict access, or terminate your account, if you breach these Terms, engage in fraudulent or unlawful activity, or for other reasons set out in these Terms. Where reasonable, we will provide notice before taking action, except where we must act to protect the security, integrity, or legality of the Service.
Provisions that by their nature should survive termination — including those on intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will remain in effect after termination.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, we disclaim any warranty that the Service will be uninterrupted, error-free, secure, or fit for a particular purpose. Any reliance on the Service is at your own risk.
This section does not affect any statutory rights you may have under EU or Romanian law that cannot be excluded or limited.
To the maximum extent permitted by applicable law, neither CognitivessAI nor its affiliates, officers, or employees shall be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or in connection with the Service.
Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or, where you have not paid anything, a reasonable amount reflecting the nature of the Service.
Nothing in these Terms limits liability that cannot be limited under applicable EU or Romanian law (for example, liability for death or personal injury caused by negligence, or for wilful misconduct or fraud).
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless CognitivessAI and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable legal costs) arising out of your use of the Service, your breach of these Terms, or your violation of the rights of a third party.
These Terms and any dispute arising out of or in connection with them are governed by the laws of Romania and the European Union, without regard to conflict-of-law rules.
Before initiating formal proceedings, we both agree to attempt in good faith to resolve any dispute informatively and, where appropriate, through mediation. Any dispute that cannot be resolved amicably shall be submitted to the competent courts of Romania. As a consumer in the EU, you may also bring proceedings in the courts of the EU member state in which you reside, and you may rely on the mandatory consumer protection rules of that country.
The European Commission provides an online dispute resolution (ODR) platform at ec.europa.eu/consumers/odr, which you may use to resolve a dispute with us as a consumer.
We may modify these Terms from time to time. We will indicate changes by updating the "Last updated" date above and, where changes are material, by providing additional notice (for example, on the Service or by email). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
